- What will change due to the fact that the AML system will be based on a regulation rather than a directive?
- The fact that the EU AML system will be based on a regulation means that there will be uniform rules across the EU. Member States will not be able to adopt rules on, for example, the application of due diligence measures that are less or more stringent than those in the AML Regulation. It means that when the regulation eventually comes into force, the Polish AML and CFT Act will have to be repealed in its current form, and the obliged institutions will have to directly apply the provisions of the AML Regulation instead.
