  1. Necessary adjustments to the organisation
    • adaptation of capital and own funds to the requirements
    • provision of managerial staff with appropriate competences
    • appointment of an AML inspector
    • appointment of an internal controller
    • appointment of a certified auditor and an audit firm
  2. Outsourcing and agents
    • proper qualification and handling of outsourcing (which services used by KIP/KIPE are not subject to the outsourcing regulations, which constitute outsourcing, which constitute qualified outsourcing, consequences, drafting of internal and contractual documentation)
    • proper qualification and appropriate conduct in dealing with agents (identification of partners who will have agent status, drafting of internal and contractual documentation)
  3. Legal qualification of products for specific payment services/e-money services
    • proper legal qualification of the services the trader intends to provide (which payment service, whether the service is regulated or exempted)
  4. Product alignment
    • proper customer relationship process (onboarding)
    • activity on Polish territory vs. cross-border activity (passporting obligation)
  5. IT infrastructure and security
    • identification of IT systems to be used for KIP/KIPE activities
    • drafting a description of the infrastructure and security processes
    • identification of cloud solutions applied by the Principal
