Cooperation between payment service providers
We advised the national payment institution on the following project:
COOPERATION BETWEEN PAYMENT SERVICE PROVIDERS IN THE PROVISION OF ACQUIRING SERVICES
- The need for cooperation between payment service providers often arises in market practice. Cooperation may be necessary, among other things, in cases when a provider who intends to offer a given service does not have appropriate technical/contractual infrastructure or experience to implement it on their own. Therefore, such an entity may decide to use services of suppliers having adequate competences and resources in this area, especially those having business relations with banks or payment organizations.
- In the case of cooperation between PSPs, it is crucial to determine the scope of activities performed by each entity, in particular in terms of outsourcing regulations. As part of the project, we supported the national payment institution in designing the contractual framework related to its collaboration with a third-party payment service provider.
The advisory services of DLK Legal included:
- legal analysis of the planned service and payment collaboration model
- recommendations on the legal classification of collaboration with another payment service provider
- recommendations as to the shape of the agreement between payment service providers
