Digital Payment Security
We are pleased to announce that experts from the DLK Law Firm were among the authors of the publication. The subsection “The Use of Artificial Intelligence in Transaction Analysis and Fraud Prevention” (pp. 142–147) was authored by dr Krzysztof Korus and Wojciech Janowski.
In the text, the authors discuss the limitations on the use of artificial intelligence in transaction analysis and fraud prevention arising from Article 5(1)(d) of the AI Act. This provision prohibits the use of AI systems to predict the risk of a natural person committing a crime. This suggests that the AI Act significantly restricts the permissible use of artificial intelligence systems for transaction monitoring in all cases where transactions potentially linked to a crime are to be identified. A closer analysis reveals, however, that the prohibition will not always apply, and payment service providers may also use AI systems to identify transactions related to crimes, provided that the anti-fraud system is properly designed.
