ECSP Regulation and the Crowdfunding Act – what we provide
- Analysis of business models in terms of being subject to the provisions of the ECSP Regulation and the Crowdfunding Act
- Authorization to operate as a crowdfunding provider (crowdfunding license)
- Preparation of the application for permit to operate as a crowdfunding service provider

- Representation in licensing proceedings before the Polish Financial Supervision Authority and support in responding to its calls

- Preparation of the notice for the Polish Financial Supervision Authority and representation before the Polish Financial Supervision Authority
- Support in the preparation of documentation to accompany the filing (credit risk assessment descriptions and processes, investor proxy templates, hedge fund policies, information on planned risk mitigation measures required of project owners)
- Preparation of full documentation to ensure compliance with the ECSP Regulation and the Crowdfunding Act:
- support in the development of a business program as well as organizational and management plan,
- development and support in implementation of internal procedures and policies (risk management, accounting procedures, internal control, complaint handling, business continuity plan, conflict of interest management, outsourcing, data processing protection including professional secrets, verification of key investment information sheets, investment limits for inexperienced investors)
- development and audit of contractual documentation with the client of the crowdfunding platform (platform rules, templates of contracts, powers of attorney)
- Support in case of supervisory audits and representation in administrative sanction proceedings before the relevant supervisory authority.
