What DLK provides with the CASP license

PREPARATORY STAGE

• assessment of the compliance of the entity and current services with CASP license requirements (procedures and policies, capitals and funds, cooperation models with partners, user agreements and regulations)
• corporate set-up or implementation of corporate changes (share capital increase, changes in company bodies)
• legal qualification of services in terms of mapping them to specific crypto-related services
• development of service descriptions and schemes

APPLICATION DOCUMENTATION STAGE

• a model action program outlining the types of crypto services to be completed by the Principal (in terms of figures and specific solutions and intentions)
• model internal procedures (risk management, internal control, AML/CFT, security strategy in the form of non-specialized language, outsourcing, statistical data, BCP, incident management, complaints, separation of crypto-assets and client funds, organization and management, headcount, conflicts of interest) to be approved by the Principal and completed in terms of specific solutions
• model internal procedures appropriate to the specific services to be provided (description of operational arrangements and market abuse detection procedure in case of operating a trading platform, order execution policy if CASP intends to execute orders for crypto-assets on behalf of clients, and other relevant documents and procedures) to be approved by the Principal and completed for specific arrangements
• model framework agreements (regulations) for the provision of cryptoassets services
• model outsourcing agreement
• assistance in the operationalization of model documentation
• dedicated forms for the Employer’s managers and shareholders for collecting warranty information (education, experience, history)
• guidelines for documentation necessary to be collected by the Employer (certificates, statements, documents)
• obtaining criminal record certificates on behalf of the Principal
• calculation of required and possessed own funds on the basis of data provided by the Principal
• application to the supervisory authority for authorization to provide services as a CASP

PROCEEDING STAGE

• periodic communication with the authority as to the progress of the case
• drafting responses to requests for additional clarifications and documents
• execution of adjustments required by the authority in the course of the proceedings
• obtaining a license (including obtaining formal confirmation of receipt of a license with the establishment of a license date)

START-UP STAGE

• assistance in updating information in registers, letters, websites
• guidelines for filling all positions and functions, as well as registry changes
• workshop on the execution of internal procedures
• instruction on payment of supervisory fees
• instruction on the execution of reporting and reporting obligations
• negotiation of contracts related to the start of operations (bank account, guarantees, etc.)
